MS has passed an abortion bill believed to be the nation's most restrictive-and state Attorney General Jim Hood says he expects an "immediate and expensive legal challenge".

The Indiana Legislature on Wednesday sent a bill to Gov. Eric Holcomb's desk that would require medical providers who treat women for complications arising from abortions to report detailed patient information to the state. Governor Phil Bryant has indicated his intent to sign it into law.

The Legislative Services Agency, in its fiscal notes on SB 340, reported that if the abortion measure is challenged as unconstitutional, the state could end up paying the legal fees of the plaintiff.

The law, which refers to the fetus as an "unborn human being" imposes fines and revocation of medical license for doctors who perform abortions after the designated 15 weeks from the mother's last period.

In June 2016, the U.S. Supreme Court ruled 5-3 against a similar law in Texas, concluding that law's demand that abortion providers have hospital admitting privileges and that clinics be regulated as surgical centers violated the U.S. Constitution.

MS has just one abortion clinic, Jackson Women's Health Organization, which has only provided abortions through 16 weeks. Chris McDaniel, a Republican from Ellisville, said the intention of the bill is to protect the lives of 15-week-old children. "They have to take off work, find gas money", she said.

Forte and University of Chicago Law Professor Geoffrey Stone both said they believe the chances the Supreme Court will consider a major abortion case are slim as long as the current justices remain, though a case could ascend quickly on an emergency appeal of a lower court ruling.

MS lawmakers may be hoping that one of the justices more favourable to abortion rights, such as Anthony Kennedy or Ruth Bader Ginsburg, will have stepped down by the time the state's case reaches the Supreme Court.
