Capitol Police arrest 70 on first day of Kavanaugh hearings

Brett Kavanaugh Democrats disrupt start of Kavanaugh hearing with protest over withheld documents

Nevertheless, the Supreme Court held that employers could require the workers to give up these rights through an email notice stating that by continuing to come to work, the workers had "agreed" not to go to court, but to pursue arbitration for any wrongdoing, and that all arbitration claims would be individual claims only. A lot is on the line for both sides.

If Kavanaugh, a staunch Republican, is confirmed, he may well tilt the court's ideology right-ward for at least a generation, as he'd replace a man who often acted as a swing vote on landmark decisions.

Still, many are fearful about his potential presence on the court, and so protestors donned clothes that looked like Margaret Atwood's characters from The Handmaid's Tale, a story about women living in a totalitarian society where they are afforded no freedom or agency.

He pointed specifically to Justice Ruth Bader Ginsburg, who during her 1993 confirmation hearing said it would be wrong for her to "preview in this legislative chamber how I would cast my vote on questions the Supreme Court may be called upon to decide" - a move that has since been dubbed the "Ginsburg rule".

Some of the sessions have focused on making sure that he is comfortable "with people shouting him down" or being heckled by protesters.

Wednesday is the second day of Judge Brett Kavanaugh's Supreme Court confirmation hearing.

"It's resisting public pressure, political pressure, it's treating everyone equally", he added of judicial independence.

Kavanaugh is a conservative judge - some scholars have argued he is one of the most conservative federal judges.

Kavanaugh has suggested that his time working in the White House was in many ways the most "instructive" to him in his career as a judge.

The BBC's Gary O'Donoghue, in Washington, says the investigation into alleged collusion between the Trump campaign and Russian Federation in the 2016 election has raised important constitutional questions about the extent to which an incumbent president can be forced to co-operate.

"It does show you how weak their hand is here", she said. Yet his past writings cast doubt on the idea.

Chemical operations staging: United States repeat scenario at Idlib war
They are to be deployed along with Russian police forces once the government begins occupying Idlib, he said. The top Syrian diplomat said, however, that Syria was determined to retake Idlib whatever its costs.

Kavanaugh later contributed to prosecutor Kenneth Starr's report into Clinton's affair with White House intern Monica Lewinsky, and which outlined several grounds for Clinton's impeachment.

"After September 11, I thought very deeply about the presidency, and I thought very deeply about the independent counsel experience, and I thought about how those things interacted", he said. "They want to elect candidates who will stand up for the people Trump threatens, not ones who compromise or cower as he and Republicans run the table in Congress and the courts", it concludes.

He told the panel - amid raucous protests inside the room - that civility is important.

Whether that's enough to assuage concerned Democrats and some Republicans is to be determined.

Democrats are expected to grill Kavanaugh on his opinion of the scope of executive power, particularly whether a sitting president should be protected from investigations while in office.

In his confirmation hearing a year ago, Justice Neil M. Gorsuch wouldn't even share his opinion on the Second Amendment.

Kavanaugh declared he would be even-handed in his approach to the law.

"Can a sitting president be required to respond to a subpoena?"

"That takes some backbone", he said of the justices who decided those cases.

He began to discuss precedent, and US v. Nixon - where the Supreme Court ruled that President Nixon had to turn over certain documents subpoenaed by a special prosecutor - before Coons cut him off to push him to answer the question at hand.
